  I think teachers can use exam questions from textbooks.  Some questions are necessary to ascertain whether learning has occurred.  I would only be concerned if the questions were used without the textbooks being purchased - that is, stripped form textbooks to avoid a purchase.  

  One would assume that the questions do not make up the majority of the book, and that the majority of the protected content - not the questions - make the work of value.
