Fair Use of a team logo for a non profit organization

The issue for this team is they need to raise money to get new equipment and to make improvements to the football field, can the logo that has been altered, even though it has some resemblence to the NE Patriots be used to manufacture merchandise and sold to raise money for a non profit organization? I belive the logo is not confusing and is meant for this football team the RV Patriots, it does not tarnish the NE patriots and so forth. Please let me know of your opinion if this is breaking the law...

Well... it might be breaking the law, it might not be breaking the law. You might think that the use is fair, or that trademark doesn't apply, but would the trademark holder agree? Have you tried asking about it? I can't say...
