Reuse of Patent Images

Hi there,
A student wants to reuse patent images in a thesis that of course is due tomorrow and published in our repository. The images are not marked as copyrighted, but I know that doesn't mean they do not have copyright. I have not seen any case law on litigation, my guess is it is being settled if this occurs. My inclination is to get permission but we probably will not get it in time, are we stuck with a defense of fair use? It is not marked who made the images but I figure the attorney or inventor would know. When would patent images enter the public domain since many times they are created by separate artists. Any thoughts?
