Library friends group selling merchandise featuring circuses that have now folded

  • A descendant of a now folded local printing press donated circus posters to our library. The donor asked the library friends group to create merchandise to sell, featuring the prints. Proceeds of friends groups sales go toward library programs.

    Some of the prints under consideration advertise circuses that have now folded, such as Polo Bros., Clyde Beatty, and Cole. Would this be considered fair use, since the proceeds are going toward the library? What advice can you offer for us to research whether there is copyright or trademark still in play?
