Using flim clips and stills in an OER

  Hi there, I have a faculty memeber creating an OER for their course.  She is wondering about using fllm clips and stills in her resource.  Can Fair Use apply?  Are there other restrictions that differentiate this 'permanent' item from say a powerpoint presentation given at a conference?  thanks
