CCC and unclaimed ILL copies

  • We currently have a policy of simply absorbing the total CCC cost for ILL articles that go over the "5 in 5" rule for a title.

    We sometimes have patrons request articles that they then don't bother to pick up (or retrieve online if delivered that way via Illiad), and we simply destroy/delete them unread.

    Some of these articles have CCC costs attached.

    My copyright question is whether we really have to pay the CCC royalty in this situation. The spirit of the law, paying for the use of the intellectual property, suggests we shouldn't, and I suspect that the CONFU negotiators and legislators would never have thought to consider that people would waste time requesting copies that are never used!
