music copyrights, lyrics and institutional repositories

  • If you were asked to post a senior music thesis that contained quotes of lyrics and chords, and also an appendix of
full lyrics for a particular singer/composer, would you or would you not? On what do you base your decision?
  • My short answer but not to be considered legal advice is this. If you are being asked to post the thesis on a limited access website (class members, university staff or some other limited group) for the purpose of education then I believe that is fair use considering the four factors because it is scholarly research, a published work, factual, and there is no signifcant effect on the market. (You can find a copy of the Four Factors checklist on the home page.) If you are being asked to post it on a website that has no access limitations then I cannot feel as positive that it is a fair use of the work. I'm sure one of my academic colleagues on the network have more insight to academic postings than I do.
