Reserves copyright question

  • A faculty member taped a program from HBO and wants to show it in her class on Autism. She also wants to make it available on reserve during the semester as streaming video via BlackBoard. Is this permissible?
  • 1. Showing in a classroom: I think the teacher could probably get away with this ONCE under the rubric of spontaneity -- but only once.
    2. Streaming video on Blackboard -- very unlikely, especially if she wants to show the whole program.

    BUT -- these days many networks make programs available through their own websites as streaming video, or make them available for purchase, with or without specific classroom licenses. I would look into this. A link to the streaming video on the network's own site would be acceptable no matter what. If the video is purchased, showing it in the classroom as part of teaching activities will always be okay. Streaming it on BlackBoard would still be iffy, unless it's done under the provisions of the TEACH Act in parallel to teaching in the classroom. Putting a short clip on electronic reserve, though, would probably be okay.
