copyright-original manuscript and its translation

  • I have an essay to be published by a French publisher, translated into French by the editorial staff. The original manuscript, which is in English, has never been published. Do I still hold the copyright to the original work in English and can submit it to a different publisher for consideration (once, or before the translated version appears in the French collection) ?

  • Your original English essay is "fixed in a tangible form" and therefore copyrighted by you -- unless you signed over the rights to the English version in your contract with them. Whether you can publish it in English in another venue depends on your agreement with your French publisher. Your agreement may state that you cannot publish it elsewhere, or that you can publish it after a certain amount of time has passed, or it may be totally silent on the issue. You'll need to take a close look at your contract and perhaps contact them directly.
