Circulating CD copies in Books with CDs

If there is no license agreement, or if you have determined that it's not binding, then copyright applies. I realize that copying software or other electronic material associated with books, has been common practice. However, my take on it is that it's not legal as a general practice. Of course, exemptions such as fair use or archival copying of obsolete material would still apply, so copying would be acceptable in some circumstances. But as a general rule, I would avoid it.
