Circulating CD copies in Books with CDs

  • Our Collection Development person wants to know if we can copy the CDs that come in Books with CDs and circulate the CD copy with the book and keep the master on file.
  • First, my experience has been that many of these CDs have associated license agreements. I'm not sure how binding they would be if you don't see them before you run the CD, but my understanding is that the ones that have agreements on the outside of the case with a sticker that you have to break to access the CD should be followed.

    If there is no license agreement, or if you have determined that it's not binding, then copyright applies. I realize that copying software or other electronic material associated with books, has been common practice. However, my take on it is that it's not legal as a general practice. Of course, exemptions such as fair use or archival copying of obsolete material would still apply, so copying would be acceptable in some circumstances. But as a general rule, I would avoid it.
