Is this stretching fair use?

  A professor asked the library to post a short story on ereserve for his senior EN class last fall. Since this was a first use, I consider it a fair use under spontanaeity. The same professor has asked the library to post the same short story on ereserve for a freshman class this spring. I can't decide if spontanaeity could again be argued as it is a different level class. Our reserve policy doesn't address this so I would welcome your opinions on this. Thanks

  If it's a different class, it's okay, but since it's the same teacher, it stretches it just a little. I'd say go ahead, but if he does it again next year, you might want to seek permission.
