Changing Art in a different medium and copyright

← Return to forum

  • As a artist I need to know that if I take a picture to paint for my subject, I was told that since I am painting it and changing the medium of the reproduction by 10% that it is ok. The same would go for using any different medium for that matter. Because it is never the same exact thing. Is this true can anyone shed any light on this.
  • If you are the one taking the picture, there are no copyright concerns. If you are painting from someone else's photograph, that's a different matter. Your use needs to be a transformative use; if you are simply copying the original in a different medium, that's not enough. You might want to read up on the Shepherd Fairey case about the Obama "Hope" poster for more information.
